Overseas Market Access Requirements Notification - Animal Products Act 1999 - MAF Biosecurity New Zealand

1. Statutory authority

Pursuant to section 60 of the Animal Products Act 1999:

(i) I notify the following overseas market access requirements, entitled poultry day-old-chicks to India.

This notice takes effect from date of signing.

2. India Requirements

Day-old-chicks exported from New Zealand to India must comply with the import requirements of India listed in this notice as follows:

2.1 An import permit is required for the exportation of day-old-chicks to India.

2.2 An official veterinarian of the New Zealand Ministry of Agriculture and Forestry, must certify, after due enquiry:

2.2.1 New Zealand is free of notifiable avian influenza. Notifiable avian influenza is defined as an infection of poultry caused by any influenza A virus of the H5 or H7 subtypes, or by any AI virus with an intravenous pathogenicity index (IVPI) greater than 1.2 (or as an alternative at least 75% mortality).

2.2.2 Vaccination against avian influenza is prohibited in New Zealand.

2.2.3 The chicks were hatched in an incubator in which no eggs from any infected source had been hatched and the incubator was properly fumigated or disinfected prior to hatching.

The chicks come from an establishment or a hatchery where infectious bursal disease (Gumboro disease), Newcastle disease, Marek’s disease, mycoplasmosis (Mycoplasma gallisepticum / M. synoviae), fowl typhoid (Salmonella Gallinarum), pullorum disease (S. Pullorum), S. Enteritidis, S. Typhimurium, fowl pox, avian infectious bronchitis, avian infectious laryngotracheitis, avian tuberculosis, psittacosis-ornithosis, fowl cholera (pasteurellosis), egg drop syndrome, avian encephalomyelitis, chicken anaemia, avian leukosis-J virus infection, and inclusion body hepatitis have not been diagnosed in the past 12 months.

2.2.4 The flocks from which the day-old-chicks originated from have been in New Zealand for at least 12 months, and during this period they did not come into contact with any imported birds.

2.2.5 The flocks of origin have never been fed with feed of meat and bone meal of ruminant.

The day-old-chicks originated from an establishment or hatchery which is regularly inspected by a MAF (Ministry of Agriculture and Forestry) Official Veterinarian.

2.2.6 The flock of origin has had serological surveillance within the 45 days prior to export (see notes for testing protocol) for HPAI (H5 and H7 subtypes) and has had negative results.

2.2.7 The day-old-chicks are being shipped in clean and disinfected, or new packages.

3. Definitions

For the purposes of this document:

Any term or expression that is defined in the Animal Products Act 1999 and used, but not defined in this document, has the same meaning as in this Act.

Explanatory note

This OMAR is based on the export certificate for day-old-chicks to India dated 8 October 2007 based on the import conditions from the Department of Animal Husbandry Dairying and Fisheries, Ministry of Agriculture, Krishi Bhawan, New Delhi, and dated 19 December 2006. It was approved in a letter of 19 June 2008, received from R.K Chaudry, (Director).

1. Samples to be collected for HPAI testing are either respiratory swabs, cloacal swabs or sera of breeding flock. All samples must be selected randomly.

2. The total number of samples to be collected is according to the size of the flock of origin:

Section 61.A of the Animal Products Amendments Act 2005 states that 'The Crown is not liable, and nor is the Director-General or any employee of the Ministry liable, for any loss arising through the refusal or failure of the relevant authority of an overseas market to admit export animal material or animal product to that market'.
