Overseas Market Access Requirements Notification - Animal Products Act 1999 - MAF Biosecurity New Zealand

1. Statutory authority
Pursuant to section 60 of the Animal Products Act 1999:
i) I notify the following overseas market access requirements, entitled laboratory rodents to Spain.
This notice takes effect from date of signing.

2. Spain requirements
Laboratory rodents exported from New Zealand to Spain must comply with the import regulations of Spain listed in this notice as follows.
2.1 An Official Veterinarian authorised by the New Zealand Ministry of Agriculture and Forestry must certify after due enquiry the following:
2.1.1 The animals for export came from a holding, officially approved body, institute or centre, controlled by the Official Veterinary Authority, and have remained in it for at least 2 months before export, or since birth.
2.1.2 The animals for export came from a holding, officially approved body, institute or centre where no cases of contagious diseases characteristic of the species have been reported for the last 30 days prior to export.
2.1.3 They have remained in isolation for 30 days prior to export, and under control of the Official Veterinary Authority.
2.1.4 They have been subjected to veterinary inspection within 5 days prior to export and no clinical disease symptoms were observed.
2.1.5 The Official Veterinarian hereby certify, that at the time of inspection, the animals described in the Export Certificate are fit for transport on the intended journey, in accordance with the provisions of Community rules.
3. Definitions
For the purposes of this document:
Any term or expression that is defined in the Animal Products Act 1999 and used, but not defined in this document, has the same meaning as in this Act.
Explanatory note
These overseas market access requirements are based on the new export certificate for the exportation of laboratory rodents to Spain, dated 7 November 2011.

1. This is a new OMAR. It is based on the model “certificado sanitario para importar en España roedores destinados a experimentación” (animal health certificate for the import into Spain of rodents to experimentation) Ref: IMP-119 MPA 6/10 provided to the exporter 20 October 2011.
2. No Import Permit is required.
3. The certificate allows for the export of laboratory rodents from a New Zealand research facility registered with MAF as a containment facility to a research facility approved with regard to EU directive 65/92/EEC in Spain.
4. With regard to clauses 2.1.1 and 2.1.3; the terms ‘controlled’ and ‘control’ should be interpreted as ‘supervised’ and ‘supervision’ respectively.
5. With regard to clause 2.1.1; the normal monitoring of containment facilities under the Biosecurity Act allows for this clause to be certified.
6. The provisions of the Community rules in regard to the transport requirements mentioned in the last paragraph of the certificate will be complied with if the animals and transport containers meet IATA specifications.
Section 61.A of the Animal Products Amendments Act 2005 states that ‘The Crown is not liable, and nor is the Director-General or any employee of the Ministry liable, for any loss arising through the refusal or failure of the relevant authority of an overseas market to admit export animal material; or animal product to that market
