Overseas Market Access Requirements Notification - Animal Products Act 1999 - MAF Biosecurity New Zealand

1. Statutory authority
Pursuant to section 60 of the Animal Products Act 1999:
(i) I notify the following overseas market access requirements and specifications, entitled Paua (NZ Abalone) to Australia.
This notice takes effect from date of signing.

2. Australian Requirements
Paua (NZ Abalone) to Australia must comply with the import requirements of Australia listed in this notice as follows:
2.1 An Import Permit is required for the exportation of paua (NZ Abalone) to Australia.
2.2 An Official Veterinarian authorised by the Ministry of Agriculture and Forestry New Zealand must certify, after due enquiry the following:
2.2.1 The Paua are in secure escape proof containers and are clearly labelled “ Live animals under quarantine ”.
2.2.2 The container meets the IATA live animal regulations.
2.2.3 The consignment is addressed to AQIS at the port of arrival.
2.3 The owner/exporter must declared that:
2.3.1 The Paua (NZ Abalone) in this consignment was:
2.3.1.1 collected from the wild or bred in New Zealand from Paua collected in the wild from within New Zealand waters, and
2.3.1.2 inspected by the owner/exporter within 3 days prior to export and found to be free of visible signs of disease and parasites.
3. Definitions
For the purposes of this document:
Any term or expression that is defined in the Animal Products Act 1999 and used, but not defined in this document, has the same meaning as in this Act.
Explanatory note
This OMAR is based on the new export certificate for Paua (NZ Abalone) to Australia dated 27 May 2009.

1. This is new OMAR and is based on the new export certificate drafted from an AQIS Import Permit for Abalone dated 25 May 2009. It was accepted by Dr Ainslie Brown on 4th May 2009 of AQIS.
2. All consignments must have a valid Import Permit.
3. The Importer must lodge a Quarantine Entry with AQIS for each arrival, and meet the post-arrival Australian requirements.
Section 61.A of the Animal Products Amendments Act 2005 states that 'The Crown is not liable, and nor is the Director-General or any employee of the Ministry liable, for any loss arising through the refusal or failure of the relevant authority of an overseas market to admit export animal material or animal product to that market'.
